TERMS & CONDITIONS OF SALE

General


Goods remain the property of Digger Spare Parts cc until paid in full.


Digger Spare Parts cc do not accept any responsibility for parts supplied incorrectly when incorrect information is supplied; or if no part number is supplied.


Parts may be returned within seven calendar days from the date of sale.


Parts supplied to the customer as per correct supplied part numbers from the customer shall incur a 15% handling fee of the total amount including VAT payable once goods have been returned and found to be in their original condition, unused, unfitted, and in their original packaging.


Returns must be accompanied by all correct and relevant paperwork; if not; acceptance will be refused.


Under no circumstance shall any refunds, returns, exchanges, or credit passed for electronic/ electrical items supplied once signed for.
Under no circumstance shall any refunds, returns, exchanges, or credit passed for wear parts/items supplied once fitted and used by the customer. This includes, but is not limited to, filters, undercarriage, tyres, opened seal/gasket kits, fluids, perishable fibre ring gears, bolts and nuts.


Under no circumstances shall any refunds, returns, exchanges, or credit passed for bearings supplied correctly once signed for.


Under no circumstance shall any refunds, returns, exchanges, or credit passed for special order items where a customer has paid upfront for goods not in stock and/or ordered/ imported specially.


Digger Spare Parts cc is not liable for any transportation costs, including courier costs, unless otherwise agreed upon, for any goods supplied.


Digger Spare Parts cc is under no obligation whatsoever to refund, return, exchange, or pass credit for goods supplied and transported via a courier service or other form of transportation not with the customer itself. Once a customer, driver, representative, or other has signed for parts ordered and supplied and leaves the premises, the goods become the full responsibility of the owner whether insured or not.


Any faulty pump units supplied by Digger Spare Parts cc shall only be eligible for refund, exchange, or return if the customer can prove, within reason and in a timely manner, that the pump unit was fitted and tested by an accredited professional and installed with proper attention paid to necessary fluids, hose pressure direction, and orientation etc,. Digger Spare Parts cc reserves the right to have the faulty pump unit tested independently via an accredited 3rd party. Should the results of said test indicate that the pump unit was installed incorrectly by the customer or customer’s representative thus causing the fault to arise, Digger Spare Parts cc reserves the right to refuse requests for refund, return, exchanges, or credit.


Digger Spare Parts cc does not offer any warranty or guarantee on parts supplied but adheres strictly to the rights and responsibilities afforded to both customer and supplier outlined in the Consumer Protection Act 68 of 2008.
Digger Spare Parts cc is not liable for consequential damages.


Digger Spare Parts cc supplies products without the duty to repair.


Any second-hand goods sold by Digger Spare Parts cc are sold as is, as seen, tested, and inspected by the customer. Should any fault or issue arise after inspection by the customer there is no duty to repair, refund, exchange, return, or pass credit.
All products contained within a sale, outlined by an invoice, shall be accepted as seen, as tested, and inspected by the customer once signed for on the official invoice.


Any customer, representative, driver, or other person collecting goods ordered on behalf of themselves or a company agrees to the general terms and conditions of sale once a physical copy of an invoice is signed. Should there be an instance where a physical copy of an invoice was not signed for any reason, by default the general terms and conditions of sale are agreed to de facto.
